THE KANSAS CITY STEAK COMPANY Chiefs PLAYOFF Tickets SWEEPSTAKES (THE “SWEEPSTAKES”) IS VOID WHERE PROHIBITED BY LAW.
THESE OFFICIAL RULES (“RULES”) ARE A LEGALLY BINDING AGREEMENT BY AND BETWEEN YOU AND SPONSOR (AS DEFINED BELOW) AND GOVERN YOUR ENTRY IN THE SWEEPSTAKES.
YOU AGREE TO ABIDE BY THESE RULES AND THE RULES, POLICIES AND PROCEDURES.
1. Sponsor. This Sweepstakes is sponsored by The Kansas City Steak Company, 12200 N. Ambassador Drive, Suite 500, Kansas City, Missouri 64163 (“Sponsor”).
2. Entry Period. The Sweepstakes begins at 10:00 AM (Central Time) on January 9, 2017 when Sponsor posts the Chiefs PLAYOFF Tickets Sweepstakes post on Sponsor's Facebook page, Twitter and/or Instagram site and ends at 5:00 PM (Central Time) on January 12th 2017. (the “Entry Period”). No entries into the Sweepstakes will be accepted before or after the Entry Period.
3. Sweepstakes Description. To participate in the Sweepstakes, you must come into the Kansas City Steak Retail Store at 5140 Kansas Avenue, KC KS 66106 during store hours of 10:00 am and 6:00 pm January 9th through January 12th and fill out a Sweepstakes entry registration form. We want to give you the chance to win two tickets and a parking pass to the KC Chiefs l Playoff Game at Arrowhead Stadium on January 15th, 2017. Winner(s) will also receive Four (4), 12 oz. Kansas City Strips, retail value = $84.95 from The Kansas City Steak Company. Here is how you're entered to win, fill out the Sweepstakes registration from in the store. We'll draw a winner on January 12th shortly after 5 pm and notify winners that evening. Ten (10) entrants will be randomly selected from all entrants that submitted a registration.
4. Eligibility. The Sweepstakes is open to legal residents of the United States of America and the District of Columbia (excluding New York , Florida and Rhode Island). You must be the age of majority or older in your state or district of residence at the beginning of the Entry Period to be eligible to participate in the Sweepstakes. Employees of Sponsor, its affiliates, subsidiaries, parent company, advertising agencies, promotional and marketing agencies, any of their respective agents and the immediate family members of each or persons with whom such employees are domiciled are not eligible to enter or win the Sweepstakes. The Sweepstakes is subject to all applicable federal, state and local laws.
5. How to Enter. You may enter this Sweepstakes by coming into The Kansas City Steaks Retail Store at 5140 Kansas Avenue, KC KS 66106 during store hours of 10:00 am and 6:00 pm January 9th through January 12th and fill out a Sweepstakes entry registration form.
Only fully completed entries are eligible. Limit 1 (one) entry per person. Additional entries submitted by the same person, are void and shall be disqualified from entry in the Sweepstakes. Upon submission, all entries (subject to your rights in your personal data specified on the entry form) shall become the exclusive property of Sponsor and will not be acknowledged or returned. Sponsor acquires and retains all rights, title and interest therein, including the ownership and copyright of any entry. Sponsor reserves the right to, and at its sole discretion may, reject any entry for failure to comply with these entry requirements.
6. Personal Data. You are required to submit personal data on the entry form. All personal data will be held, used and processed by Sponsor in accordance with its Privacy Policy as the Privacy Policy shall be posted at www.kansascitysteaks.com from time to time.
7. Warranties and Consents. By completing and submitting an entry form, you: (a) represent and warrant that (i) you have read, and agree to be bound by, these Rules (ii) based on the Rules, you are eligible to participate in the Sweepstakes, and (iii) all of the information provided as part of your entry is accurate, does not violate any third party's legal rights (including without limitation rights of privacy and publicity), and otherwise does not violate applicable law; (b) consent to the use of your name and/or likeness by Sponsor for promotional purposes (whether online, in print or through any other media now known or hereafter developed), without additional compensation or authorization unless prohibited by law; and (c) agree to be bound by the interpretations of these Rules by Sponsor, which are final in all matters relating to the Sweepstakes.
8. Selection of Winners. Sponsor will randomly select the ten (10) winning entries from all the eligible entries received.
9. Winners Notification; Odds. Sponsor will notify each potential Winner via phone at the number provided in the entry. If Sponsor cannot reach the potential Winner within 24 hours of notification, the potential Winner may forfeit the Prize at Sponsor's discretion and Sponsor may choose an alternate Winner. The odds of winning a Prize are dependent upon the number of eligible entries received by Sponsor.
10. Prizes. Ten (10) Winners will each receive two tickets and a parking pass to the KC Chiefs Playoff Game at Arrowhead Stadium on January 15th, 2017, entry to a tailgate party sponsored by Sponsor, and four (4), 12 oz. Kansas City Strips from The Kansas City Steak Company. Approximate retail value of each prize package is $529.95 USD (Total ARV $5,299.50). None of the Prizes can be transferred, substituted or redeemed for cash, except as required by law. Sponsor shall have no responsibility or obligation to a Winner or potential Winner who is unable to accept or utilize any of the Prizes as described herein. In the case of a Winner's forfeiture of a Prize, Sponsor may select another winner according to these Rules. Each Winner is fully responsible for any and all applicable federal, state, territory and local taxes (including income and withholding taxes) associated with their respective Prize and will and hereby does hold Sponsor harmless from liability for failure to timely report and/or pay such taxes. In the case of a potential Winner's forfeiture of a Prize or inability to accept or use the Prize for any reason, Sponsor may select another winner according to these Rules and will not owe the original potential Winner any compensation. Limit one winner per household.
Prize Conditions:
All costs and expenses associated with the Prize acceptance and use not specified herein as being provided, including but not limited to lodging, transportation costs, meals,gratuities and other expenses incurred by accepting the Prize are the sole responsibility of each individual Winner. The Prizes are non-transferable and non-assignable, with no cash redemptions except at Sponsor's sole and absolute discretion. Sponsor reserves the right to substitute any Prize (or any portion thereof) with a prize of comparable or greater value at its sole and absolute discretion. Additional Prize Conditions Applicable To The Grand Prize: TRANSPORTATION TO/FROM THE GAME, EVENT OR EXHIBITION AND LODGING NOT INCLUDED. Seat locations at the game shall be determined in the sole discretion of Sponsor. Grand Prize Winner's companions must be of legal age of majority in their jurisdictions of residence (and at least eighteen (18) years of age), unless accompanied by a parent or legal guardian. National Football League game, event and exhibition dates and times are determined in the sole discretion of the Office of the National Football League Football Operations and/or the applicable National Football League, and may be subject to change. The terms and conditions of the tickets awarded as part of the Grand Prize will govern in the event a legal game, event or exhibition, as defined by National Football League, is not played or held, as applicable, due to weather conditions, an act of God, an act of terrorism, civil disturbance or any other reason. Grand Prize Winner and his/her guest(s) agree to comply with all applicable ballpark and venue, as applicable, regulations in connection with the Grand Prize. Sponsor and the applicable NFL Entities reserve the right to remove or to deny entry to Grand Prize Winner and/or his/her guest(s) who engage(s) in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at the game, event or exhibition. Released Parties (defined below) will not be responsible for weather conditions, Acts of God, acts of terrorism, civil disturbances, work stoppage or any other natural disaster outside their control that may cause the cancellation or postponement of any National Football League game, event or exhibition. National Football League game, event and exhibition tickets awarded as prizes may not be resold or offered for resale. Any such resale may result in disqualification and Grand Prize forfeiture, and may invalidate the license granted by the game, event or exhibition ticket(s).
13. General Terms. Your noncompliance with any of these Rules, may result inyour disqualification. Sponsor is not responsible for anything outside of its reasonable control. Sponsor assumes no responsibility for incorrect or inaccurate entry information whether caused by any of the equipment or programming associated with or utilized in this Sweepstakes or by any human error which may occur in the processing of the entries in this Sweepstakes. Sponsor is not responsible for any typographical or other error in the printing of the Sweepstakes, administration of the Sweepstakes, or in the announcement of the Prizes and the Winners.
14. Publicity; Press Releases. You may not issue press releases or other publicity in connection with your participation in the Sweepstakes. Except where prohibited, acceptance of a Prize constitutes Winner's consent that their name, likeness, voice and/or biographical data for both Winner and guest may be used in any medium for advertising and promotional purposes without limitation and without additional notice, compensation or consent.
15. Indemnification. By entering the Sweepstakes, you agree to indemnify, defend (at Sponsor's, the respective Sponsor Entity's, as applicable), and hold harmless Sponsor, each of Sponsor Entities, the Social Media Sites and their respective officers, directors, partners, members, shareholders, executors, family members, heirs and assigns from and against any and all liability, damages or causes of action (however named or described), with respect to or arising out of either (i) your participation in the Sweepstakes including without limitation, the breach of violation of your representations and warranties; and/or (ii) the receipt, redemption or use of the Prizes awarded in the Sweepstakes. You shall release all rights to bring any claim, action or proceeding against Sponsor, and further covenant not to sue Sponsor, and hereby acknowledge that none of Sponsor, any Sponsor Entity has made or is in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to the Sweepstakes or the Prizes.
16. LIMITATION OF LIABILITY. SPONSOR WILL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DAMAGES ARISING OUT OF, RELATING TO OR CONNECTED WITH THE SWEEPSTAKES, INCLUDING, BUT NOT LIMITED TO, CONSEQUENTIAL, INCIDENTAL, INDIRECT, PUNITIVE OR SPECIAL DAMAGES WHETHER OR NOT SUCH DAMAGES ARE RELATED TO LOST PROFITS, LOST DATA OR LOSS OF GOODWILL, AND WHETHER IN CONTRACT, TORT OR ANY OTHER LEGAL THEORY, REGARDLESS OF THE CAUSE OF ACTION ON WHICH THEY ARE BASED, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OCCURRING.
18. LEGAL RIGHTS. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS PROVIDED ABOVE OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.
19. Request for the Names of the Winners and Rules. For the name of the Winners and/or a copy of these Rules, send a self-addressed stamped envelope to:

20. Waiver. No failure or delay by a party in exercising any right, power, or privilege under these Rules will operate as a waiver thereof. No waiver of any provision of these Rules, or any rights or obligations of either party under these Rules, shall be effective, except pursuant to a written instrument signed by the party waiving compliance, and any such waiver shall be effective only in the specific instance and for the specific purpose stated in such writing.
21. Severability. Any provision of these Rules that is found invalid or unenforceable pursuant to judicial decree or decision shall be ineffective to the extent of such invalidity or unenforceability, and the remainder of these Rules shall remain valid and enforceable according to their terms. If any provision of these Rules is so broad as to be unenforceable, the provision shall be interpreted to be only so broad as is enforceable.
22. Social Media Role. This Sweepstakes is in no way sponsored, endorsed, administered by or associated with Facebook, Twitter, Instagram or any other social media site (“Social Media Sites”). Entrants are providing their personal information to Sponsor, and not to the Social Media Sites.
23. Dispute Resolution/Choice of Law. Issues concerning the construction, validity, interpretation and enforceability of these Official Rules shall be governed by the laws of the State of Missouri. All disputes arising out of or connected with this Sweepstakes will be resolved individually, and without resort to class action, exclusively by the appropriate federal or Missouri State Court. Should there be a conflict between the laws of the State of Missouri and any other laws, the conflict will be resolved in favor of the laws of the State of Missouri. All judgments or awards shall be limited to actual incurred out-of-pocket expenses (excluding attorneys' fees) associated with participation in this Sweepstakes and shall not include any indirect, punitive, incidental and/or consequential damages.
